What is a Condominium Property Regime, or CPR on Kauai? 

Find out here! I get this question a lot especially when showing property. What is a CPR on Kauai? A CPR is a “condominium property regime” and is just a form of ownership.

CPR’s on Kauai can come in many different forms:

  • Residential properties.
  • Condos attached or detached.
  • Vacant land pieces.
  • A residential home split in two, thirds, fourths etc. like a duplex and fourplex.

How do I know if a property is a CPR?

  • A listing will either say ownership: Full or ownership: CPR.
  • By looking at the TMK number. TMK numbers that are not CPR’s look like this 4-4-6-5-32 while CPR’s will have an extra digit at the end and look like 4-4-6-5-32-1 <—- the last number stands for the unit so this would be unit 1.

What can be CPR’d on Kauai?

When creating a CPR on Kauai creating the CPR does not define density. The county CZO ordinances define the density. For example almost anything can be CPR’d. However, if someone were to CPR their piece of land into 2 units and the county only allows one dwelling on the property it wouldn’t make sense to CPR. Unless someone knows a buyer that wants to purchase land thats not build-able. Whether the property qualifies for another dwelling depends on the zoning, size and county zoning ordinances.

Important information when purchasing a CPR on Kauai

Condo apartments are CPR’s and are expected to have common spaces for example pools, BBQ areas, recreational rooms. Typically they have a monthly HOA fee and certain rules. Residential and Agricultural CPR’s can also have rules, maintenance fee’s and common areas all of these will be noted in the condominium/CPR documents.

Always request to see a CPR map and documents before purchasing a CPR on Kauai. All of the house rules and if the land is allowed a building site should be noted in the CPR docs. If this is the first time a property is selling as a CPR the seller needs to deliver the  sellers public report to the buyer before purchasing and the buyer has 30 days to review and rescind.

TIP: Review the CPR docs restrictions. Some CPR documents will have specific restrictions like NO chickens, pigs, cows, goats, etc. Or homes must be at least 2,000 sq. ft. Be sure future plans coincide with CPR Restrictions!
